1. Definitions

In these Terms and Conditions, the following terms carry specific meanings. "Tassik", "we", "our", or "us" refers to Tassik, operating from 5 Jalan Teknokrat 3, Cyberjaya, 63000 Selangor, Malaysia. "Service" or "Services" refers to the AI consulting solutions we offer, including computer vision, natural language processing, and data enrichment. "User", "you", or "your" refers to any individual or organisation accessing our website or engaging our services. "Website" refers to https://tassikens.live. "Agreement" refers to these Terms and Conditions together with any service-specific engagement contracts.

2. Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are acting on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.

3. Description of Services

Tassik provides AI consulting services to organisations in Malaysia and the broader Southeast Asian region. Our core offerings include Computer Vision Solutions, Natural Language Processing Services, and AI-Powered Data Enrichment. Each engagement is scoped individually through a discovery process, and the specific deliverables, timelines, and terms are defined in a separate service agreement. The information on our website is intended to provide a general overview and does not constitute a binding offer.

4. User Responsibilities

When using our website, you agree to use it for lawful purposes only and refrain from activities that could disrupt or damage the site's functionality, attempt to access systems or data beyond what is publicly available, misrepresent your identity or affiliation, or use any content from the site for purposes that infringe on our intellectual property rights. When engaging our services, you are responsible for providing accurate and timely information, ensuring that any data shared with us has been collected and can be shared in compliance with applicable law, and cooperating with our team during the project lifecycle.

5. Intellectual Property

All content on our website — including text, graphics, logos, and design — is the property of Tassik or its licensors and is protected under Malaysian intellectual property laws. You may view and download content for personal, non-commercial reference only. You may not reproduce, distribute, or modify any material from our website without our written permission. For deliverables produced during a service engagement, ownership and licensing terms are specified in the relevant service agreement.

6. Payment Terms

Service pricing is quoted in Malaysian Ringgit (RM) and is outlined during the proposal stage. Payment schedules, methods, and milestones are defined in individual service agreements. Unless otherwise stated, prices listed on our website reflect base rates and may vary depending on project scope. Late payments may incur additional charges as specified in the service agreement. We reserve the right to suspend work on a project if payments remain overdue beyond 30 days.

7. Service Delivery and Scope

The scope of each engagement is defined collaboratively during the discovery and proposal phase. Changes to scope after project commencement may affect timelines and pricing — any such changes will be discussed and documented before proceeding. We aim to deliver work within the agreed timelines but cannot always account for delays arising from circumstances outside our control, including delays in receiving necessary data, feedback, or approvals from the client.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information exchanged during the course of an engagement. This includes business strategies, datasets, model architectures, and financial details. Confidentiality obligations survive the termination of the engagement for a period of 24 months, unless a longer period is specified in the service agreement.

9. Disclaimers

Our website and its content are provided on an "as is" basis. While we make every effort to ensure accuracy, we do not warrant that the information is always complete, current, or error-free. AI solutions involve inherent variability, and outcomes depend on the quality and quantity of data provided, as well as the specific conditions of your use case. We do not make representations about the suitability of our services for every situation. The insights and guidance shared on our site are general in nature and are not a substitute for professional advice specific to your circumstances.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Tassik's total liability for any claim arising from or related to our services or website shall not exceed the total fees paid by the client for the specific engagement giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities. Nothing in these terms seeks to exclude liability that cannot lawfully be excluded.

11. Indemnification

You agree to indemnify and hold harmless Tassik, its directors, employees, and agents from any claims, damages, or expenses arising from your breach of these terms, your misuse of our website or services, or any violation of applicable law or third-party rights in connection with your use of our deliverables.

12. Termination

Either party may terminate a service engagement in accordance with the terms set out in the relevant service agreement. We reserve the right to restrict or terminate access to our website for any user who violates these terms. Upon termination of a service engagement, both parties remain bound by the confidentiality, intellectual property, and liability provisions outlined here and in the service agreement.

13. Force Majeure

Neither party shall be held liable for failure or delay in performing obligations resulting from events beyond reasonable control, including natural disasters, government actions, pandemics, cyberattacks, or infrastructure failures. In such events, the affected party shall notify the other promptly and both parties shall work in good faith to mitigate the impact.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or from the use of our website or services shall be subject to the jurisdiction of the courts of Malaysia, located in Selangor. Before initiating formal proceedings, both parties agree to attempt resolution through informal discussion within 30 days of the dispute arising.

15. General Provisions

These Terms and Conditions, together with any applicable service agreement, represent the entire understanding between you and Tassik. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force. Our failure to enforce any right under these terms does not constitute a waiver of that right. We may not assign our obligations under these terms without notice to you, except in the event of a business transfer.

16. Changes to These Terms

We may revise these Terms and Conditions from time to time. Material changes will be reflected by updating the "Last Updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
